Buying Alcohol in Georgia: ID, Delivery and Rules

We get asked the same handful of legal questions every week, usually by people who have just moved to Georgia and discovered the rules here are not the rules where they came from. None of this is legal advice - we sell bottles, we do not practise law - but this is how it actually plays out at a Doraville counter.

ID: why we card people who are obviously over 21

The drinking age in Georgia is 21. The detail that explains everything else is where the penalty lands: when a sale to someone underage happens, the consequences fall on the clerk and on the store's licence, not on the buyer. The licence is the whole business. That is why a cashier will ask a grey-haired customer for identification without blinking. It is not a judgement about how you look; carding everybody is simply the only defensible habit.

What works: an unexpired driver's licence or state ID card, a US military ID, or a passport. What does not: a photograph of your licence on your phone, an expired card, or a friend vouching for you. Bring the physical card.

One that catches people out - if you are buying for a group and somebody in that group cannot produce ID, the sale cannot go ahead. That is not the store being difficult. Buying on behalf of someone underage is a separate offence, and from behind the counter the innocent situation and the illegal one look identical.

What a package store sells that a grocery store cannot

Georgia draws a hard line between beer and wine on one side and distilled spirits on the other. Grocery and convenience stores can sell beer and wine. Only a licensed package store can sell distilled spirits - the whiskey, vodka, gin, tequila and rum aisle. That single rule is why a store like ours exists as a separate building rather than an aisle in somebody's supermarket.

The second distinction is "package" versus "by the drink". We are a package store, so everything leaves sealed and unopened, to be drunk somewhere else. Restaurants and bars hold an entirely different licence. It is also why we cannot open a bottle for you, and why a tasting is a specific licensed event rather than something we can do on request.

Delivery

Georgia permits licensed retailers to deliver beer, wine and spirits to homes, and we deliver across Doraville, Chamblee, Norcross, Dunwoody, Brookhaven, Peachtree Corners, Tucker, Duluth, Sandy Springs and into Atlanta. The parts that affect you:

• Somebody 21 or over has to be there to receive it and show ID at the door. It does not have to be the person who placed the order, but it has to be a person, with a card.
• It cannot be left on the porch. If nobody answers, it comes back to the store.
• The driver can refuse the handover if the person receiving it appears intoxicated. That is a legal obligation, not a judgement call.

Plan for somebody to be home. By far the most common delivery problem we see is an order scheduled for a window when the house is empty.

Sundays

Sunday package sales are permitted in Doraville under city ordinance, and we are open on Sundays. In the car

Georgia's open container law prohibits an open alcoholic beverage in the passenger area of a vehicle on a public road. It applies to passengers and not only to the driver, and it applies whether the car is moving or pulled over on the shoulder. Sealed bottles and unopened packs are fine anywhere in the car. Anything already opened belongs in the trunk - or better, back where you opened it.

Short answers to the other regulars

• Can I return a bottle? Generally no. Georgia restricts the resale of returned alcohol, so once it leaves the store it cannot go back on the shelf. Damaged or faulty product is a different conversation entirely - bring it in and talk to us.
• Can you ship to another state? No. Retail interstate shipping of spirits requires licensing in every state involved.
• Can I bring my children in? Yes. Minors may be inside a package store; they simply cannot make or handle the purchase.
